13Data processing agreement

Our DPA, which you can find here, applies when applicable.

14What this policy covers, and what it does not

This policy covers the personal data Pertento AB decides the purposes for: visitors to this website, people who write to us or request a demonstration, and the people who hold and use accounts on the platform. For that data Pertento AB is the data controller.

It does not cover the data the Pertento script collects on a customer’s own website. There, the customer decides why the data is collected and is the data controller; Pertento is the processor and acts on that customer’s instructions. Our data processing agreement governs that processing, and it is the customer’s own privacy notice, not this one, that describes it to their visitors.

15Why we process personal data, and on what basis

Section 7 above lists the grounds we rely on. This is which ground applies to which purpose.

PurposeLawful basis
Answering an enquiry or a demonstration request you send usSteps taken at your request before entering a contract, or our legitimate interest in replying to people who contact us
Providing the platform to the organisation you work for, and administering its accountPerformance of our contract with that organisation
Keeping the service available and secure, and preventing abuseOur legitimate interest in a service that stays up and is not misused
Telling you about Pertento products and changes to themYour consent, or our legitimate interest in writing to an existing business customer. You can object at any time
Meeting our accounting, tax and other legal obligationsCompliance with a legal obligation

16Who we share personal data with

We do not sell personal data, and we do not share it for cross-context behavioural advertising.

We use service providers that process personal data on our behalf, under contract and on our instructions, to host this website, to deliver the email we send, to process payments, and to run the content system behind our news and documentation. They may not use the data for their own purposes.

We disclose personal data to a public authority only where the law requires it of us.

If Pertento is ever part of a merger, an acquisition or a sale of assets, personal data may transfer with the business. We will say so before it becomes subject to a different privacy policy.

17How long we keep it

We keep personal data only for as long as the purpose we collected it for requires, and then delete it. Two things fix a period rather than a judgement: accounting records, which Swedish law requires us to keep for seven years, and anything we are told to preserve for a legal claim.

Ask us how long we hold a particular category of data and we will tell you.

18Exercising your rights

To use any of the rights in Section 10, write to hello@pertento.ai. We answer within one month. Where a request is complex, or where you have made several, we may take up to two months longer, and we will tell you within the first month if that is going to happen.

We may need to confirm who you are before we act, and we will not ask for more than we need in order to do that.

If you are not satisfied with how we have handled your data, you can complain to the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten, IMY), or to the supervisory authority of the country where you live or work.

19California privacy rights

This section applies if you are a California resident, and uses the meanings the California Consumer Privacy Act gives its terms.

In the last twelve months we have collected the categories of personal information listed in Section 3: identifiers such as your name and email address, professional information such as your company, your role and the size of your company, and internet activity relating to your use of this website. We collect them for the purposes set out above. We do not collect sensitive personal information.

We have not sold personal information, and we have not shared it for cross-context behavioural advertising, in the preceding twelve months.

You have the right to know what we have collected about you, to have it deleted, to have it corrected, and not to be treated differently for exercising any of those rights. Write to hello@pertento.ai to use them. An authorised agent may act for you, and we may ask for proof of their authority.

20Children

This website and the platform are for business use and are not directed to children. We do not knowingly collect personal data from anyone under 16, and we delete it if we find we have.

21Automated decision-making

We do not make decisions about you by automated means that produce legal effects concerning you or that similarly significantly affect you.

22Security of this website

This website is served over HTTPS only, from a server in Helsinki, Finland. Access to personal data inside Pertento is limited to the people who need it to do their work, on the same need-to-know and least-privilege basis our data processing agreement commits to.
